Terms of Service

These Terms of Service govern your use of LWH Media Center at https://tv.leewaihong.com (the Service), operated by Lee Wai Hong (003436479-V) (we, us, or our). By accessing or using the Service, you agree to these Terms.

1. Eligibility and accounts

You must provide accurate account information, keep your credentials secure, and take responsibility for activity under your account. You may not use another person's account without permission or use the Service where doing so would be unlawful.

2. Creator content and licences

You retain ownership of content you upload. You confirm that you have the rights and permissions required to upload, process, publish, and distribute it.

You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, transcode, create technical variants and thumbnails, display, stream, and distribute your content only as needed to operate, secure, improve, and provide the Service and the distribution options you choose. This licence ends when the relevant content is deleted, subject to reasonable backups, legal obligations, and content already delivered to third-party platforms.

3. Third-party distribution

If you connect Facebook, TikTok, or another platform and expressly select it when publishing, you authorise the Service to send the selected content, caption, privacy setting, and related metadata to that platform. Third-party services have their own terms, policies, processing times, availability, and moderation rules. We do not guarantee acceptance, publication, reach, or continued availability on a third-party platform.

Disconnecting an account from LWH Media Center removes or disables the local connection where supported, but does not automatically delete content already published on the third-party platform. You must manage or delete that content through the relevant platform.

4. Acceptable use

You must not upload or distribute content that is unlawful, infringing, deceptive, abusive, sexually exploitative, malicious, or harmful; impersonate others; interfere with the Service; probe or bypass security; introduce malware; scrape or automate access without permission; or use the Service to violate another platform's rules.

5. Moderation and removal

We may restrict, unpublish, remove, or preserve content and suspend access when reasonably necessary to address legal requests, intellectual-property claims, safety or security risks, these Terms, or third-party platform requirements. We may contact you before taking action where practical, but urgent action may be taken without notice.

6. Availability and changes

The Service may change, be interrupted, or undergo maintenance. Processing, storage, streaming, and third-party publishing depend on networks and service providers outside our control. We may update features and reasonable limits while seeking to avoid unnecessary disruption.

7. Memberships and payments

Where paid features are offered, prices, billing periods, renewal terms, and cancellation options will be shown before purchase. Third-party payment providers may process payment data under their own policies.

8. Termination

You may stop using the Service or request account deletion. We may suspend or terminate access for a material or repeated breach, legal requirement, fraud, or security risk. Provisions that by their nature should survive termination—including ownership, accrued obligations, disclaimers, and liability limits—will survive.

9. Disclaimers and liability

To the extent permitted by law, the Service is provided on an “as available” basis without warranties that it will be uninterrupted or error-free. We are not liable for indirect, incidental, special, or consequential loss, loss of profits or data, or third-party platform decisions. Nothing in these Terms excludes liability that cannot lawfully be excluded.

You are responsible for claims arising from content you upload, your violation of law or third-party rights, or your misuse of the Service, to the extent permitted by law.

10. Governing law

These Terms are governed by the laws applicable in Kuala Lumpur, Malaysia. Courts with competent jurisdiction in Kuala Lumpur will have jurisdiction, subject to any mandatory consumer protections.

11. Changes and contact

We may update these Terms and will publish the revised effective date on this page. Material changes may also be communicated through the Service.

1. 資格與帳戶

你必須提供正確資料、妥善保管登入憑證，並對帳戶內的活動負責。未經許可不得使用他人帳戶，亦不得在使用本服務屬違法的地區使用本服務。

2. 創作者內容與授權

你保留所上載內容的擁有權，並確認已取得上載、處理、發佈及分發內容所需的權利與許可。

你授予我們非專屬、全球性、免版稅的授權，僅為營運、保護、改善及提供本服務與你選擇的分發功能，而託管、複製、轉碼、產生技術版本及縮圖、展示、串流及分發內容。內容刪除後，此授權原則上終止，但合理備份、法律義務及已傳送至第三方平台的內容除外。

3. 第三方平台分發

當你連接 Facebook、TikTok 或其他平台，並在發佈時明確選擇該平台，即授權本服務把所選內容、說明文字、私隱設定及相關資料傳送至該平台。第三方服務受其本身的條款、政策、處理時間、可用性及審核規則約束；我們不保證內容獲接受、發佈、觸及或持續存在。

解除 LWH Media Center 的帳戶連接會在支援的情況下移除或停用本地連線，但不會自動刪除已發佈到第三方平台的內容。你須在相關平台自行管理或刪除該內容。

4. 可接受使用

你不得上載或分發違法、侵權、欺詐、侮辱、剝削、惡意或有害內容；冒充他人；干擾服務；探測或繞過保安；植入惡意程式；未經許可擷取或自動存取；或利用本服務違反其他平台規則。

5. 審核與移除

如為處理法律要求、知識產權申訴、安全風險、本條款或第三方平台規定而有合理需要，我們可限制、取消發佈、移除或保存內容，以及暫停帳戶。可行情況下會先聯絡你，但緊急情況可不作事前通知。

6. 可用性與變更

本服務可能更新、中斷或維護。處理、儲存、串流及第三方發佈依賴我們無法完全控制的網絡及服務供應商。我們可更新功能及合理限制，並會盡力避免不必要的影響。

7. 會員與付款

如提供收費功能，價格、計費週期、續訂及取消方式會在購買前顯示。付款資料可能由第三方付款服務商按其政策處理。

8. 終止

你可停止使用服務或要求刪除帳戶。如有重大或重複違規、法律要求、欺詐或安全風險，我們可暫停或終止存取。按性質應持續有效的條文，包括擁有權、已產生義務、免責聲明及責任限制，將在終止後繼續有效。

9. 免責與責任限制

在法律允許範圍內，本服務按「可用狀態」提供，不保證不中斷或完全無誤。我們不對間接、附帶、特殊或相應損失、利潤或資料損失，以及第三方平台決定負責。本條款不排除法律禁止排除的責任。

在法律允許範圍內，你須對因所上載內容、違法或侵犯第三方權利、或不當使用服務而引起的申索負責。

10. 管轄法律

本條款受 Kuala Lumpur, Malaysia 適用法律管轄，並由吉隆坡有管轄權的法院處理，但不影響任何強制性消費者保障。

11. 變更與聯絡

我們可更新本條款，並會在本頁列出新的生效日期。重大變更亦可能透過本服務通知。
